Slum Rehabilitation Scheme - Patra and Apatra Criteria for SR Scheme

1. What is Slum Rehabilitation Scheme ( SRS ) and Slum Rehabilitation Authority ( SRA ) ??

👉SRS is innovative concept of Government of Maharashtra was introduced in 1995 wherein declared slum land used as resource and allowing incentive FSI in terms of tenements for sale in open market for cross subsidization of rehab component and SRA is Special Planning Authority for all slum areas in the jurisdiction of Municipal Corporation of Greater Mumbai, Thane.




2. Patra (Eligible) and Apatra (Non Eligible) candidates in SR Scheme??

👉 Every Slum dwellers existing as on 01/01/2000 and his name is enrolled in legislative assembly voter List of 2000 is Patra (Eligible) for new tenement under SR Scheme free of cost and Apatra (Non Eligible) candidates are those who constructed their house on SRl landl post year 2000 or don’t have sufficient documents that proves their presence before year 2000 apart from this there are many reason for Non eligibility. (Example for Non eligibility – Flat locked during survey / occupied by Tenant etc).

The Hutment dweller actually residing at present who has purchased the censused structure with photo pass, If any from any of the categories shall be held eligible for rehabilitation under SRS, provided such transfer has been regularized. Provided further that the original owner of censused structure who has sold the said hut shall be deemed to be ineligible for any alternative subsidized accommodation in any of the government scheme.

However as per latest SRA GR Dated – 16th May 2019, Slum Dwellers exist post 01/01/2000 but before 01/01/2011 self occupied hut can be rehabilitated under SR Scheme by paying construction cost quoted by SRA / Developer.

3. Eligibility Criteria for Hutment Dwellers.

👉The hutment dwellers actually residing in hut will be eligible for the benefit or redevelopment scheme fulfilling below mentioned criteria.

(1) He / She is the original owner of structure as per census conducted in 2000 or is in possession photopass issued by a competent authority in his name .

(2) If the original hutment dweller is deceased and his legal heir is present occupant.

(3) The hutment dweller actually residing at present has purchased the censused structure with Photopass from any of the above categories above and that this transfer has been regularized.

(4) Subject to the foregoing provisions, only the actual occupant of a hutment shall be held eligible, Other than the actual occupant, If any even if his name is shown in the electoral roll of the slum area, Shall have no right whatsoever to the rehabilitation tenement against that structure.

4. Documents proves eligibility under SR Scheme are mentioned hereunder.

👉 Slum Survey receipt issued in 2000 and all payment receipt regards of slum survey charges + Photopass (Slum identity Card) issued in favor of hutment owner + legislative assembly voter List of 2000 showing his name + Electricity bills + Agreement for sale, power of attorney, affidavit – In case of purchase + Slum dwellers name must be included in Annexure 2 issued by competent authority.

5. Is it possible to become Patra (Eligible) candidate once he declared Apatra (Non Eligible) in annexure 2 ?

👉 Yes if he/she have all the above mentioned required documents to prove his eligibility under SR Scheme, as most of time peoples declared as Apatra (Non Eligible) due to flat locked / occupied by tenant / misinterpretation by society members during slum survey.

6. What is annexure 2 and it’s importance in SR Scheme?

👉 Annexure 2 is list of eligible and non eligible candidate residing on slum plot during inspection issued by competent authority post survey of structure as well as required documents and it is most important document in SR Development scheme based on this consent of 51% eligible candidates required for redevelopment.

7. Transfer of Photopass??

👉 Since only the actual occupant at present will be eligible for redevelopment, There shall be no need to regularize the transfer of photopass that have occurred so far, A photopass will be given after the new tenement has been allotted under SR Scheme.

8. Rights of slum dwellers under SR Scheme.

👉 Protected slum dwellers as defined in chapter I-B of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 and order issued there under is eligible for residential tenement having a carpet area totaling to 27.88Sq.m (300Sq.ft) / Commercial – 225.00Sq.ft only.

For those structures having residential areas more than 27.88 sq.m (300 sq. ft.) will be eligible for residential tenement having carpet area totaling to 37.16 sq. m (400 sq. ft.). Out of this total 37.16 sq. m area, 27.88 sq. m (300 sq. ft.) area will be free of cost and area above 27.88 sq. m (300 sq. ft.) admeasuring 9.29 sq. m (100 sq. ft.) will be at construction cost to be determined by OSD, DRP (SRA) and the said cost to be paid by the hutment dweller to the developer- (Special Provision under section 33(10A) of DCPR 2034 only for Dharavi Notified Area).

      Mere pass first owner ka photo pass aur 1970 ke document he lekin 2006 me annexture 2 me uska naam tha mene 2013 me room first owner se purchases kiya ab 2022 Builder aya usne muje apatra bataya please give me solution

Ye possibly isliye b hosakta he ki last inspection ke time apne ya apke society ne apke old owner ke documents submit kiye ho, ab ya to apke old owner ke complete dcuments submit kariye aur unke name par patra karwa ke allotment le le jo thoda risky ho sakta he n 2nd option ye ki SRA approach kare n apki ownership claim kare process thoda lamba n costly hoga lekin allotment direct apke name par hoga....

  5. I bought SRA flat in 2010 in the name of my mother and myself. My mother was deceased in 2013 and the flat was transferred to builder's name as we're getting maintainence slip from Lakdawala Developers name from the society. I need to transfer the flat on my own name. I have share certificate, allotment letter, sale deed. Please help me out with the procedure.

    1. I think you should approach your society members firstly then with their joint consent you can approach your local SRA office to transfer it in your favor with documented base......
